Terms of Service
These Terms of Service explain the baseline rules for using the MobyTechy website, requesting information, communicating with us, and using our digital service resources.
Last Updated: June 21, 2026
1. Acceptance of Terms
By accessing the website, submitting a form, requesting an audit or quote, using client resources, or communicating with MobyTechy about services, you agree to these terms and any additional written terms that apply to a specific project or service.
2. Services
MobyTechy provides digital services that may include websites, web applications, mobile apps, backend systems, UI/UX design, SEO foundations, analytics, conversion improvement, marketing workflows, DevOps support, audits, consulting, and related technical delivery.
3. Proposals, Scope, and Changes
Public website content, examples, audits, or informal conversations do not create a final project scope by themselves. Scope, deliverables, timelines, responsibilities, fees, payment milestones, and acceptance criteria should be confirmed in a written proposal, contract, invoice, or other agreed project document. Changes may affect cost and timeline.
4. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, required approvals, lawful content, access credentials, brand assets, third-party account access, and any materials needed to complete agreed work. Delays in these items may affect delivery timelines.
5. Accounts, Access, and Security
If you receive access to a client dashboard, support portal, proposal, file, repository, hosting account, or other workspace, you are responsible for keeping credentials secure and notifying us promptly if access is lost, misused, or compromised.
6. Content, Materials, and Rights
You confirm that materials you provide to MobyTechy, including text, images, logos, data, files, credentials, and third-party assets, may be used for the requested work and do not violate the rights of others. Ownership and license terms for final deliverables should be defined in the applicable project agreement.
7. Third-Party Services
Projects may rely on third-party platforms such as hosting providers, domain registrars, payment processors, analytics tools, email providers, ad platforms, APIs, app stores, or cloud services. Those services may have their own terms, pricing, limits, security rules, and availability outside MobyTechy's control.
8. No Guaranteed Results
MobyTechy aims to provide practical, reliable work, but we do not guarantee search rankings, advertising performance, revenue, funding, traffic, uptime from third-party providers, or business outcomes unless a specific written agreement says otherwise.
9. Acceptable Use
You agree not to misuse the website, forms, client portals, support channels, or services, including by attempting unauthorized access, submitting harmful code, abusing infrastructure, infringing rights, sending unlawful content, or interfering with service operation.
10. Limitation and Updates
To the maximum extent allowed by applicable law, MobyTechy is not responsible for indirect, incidental, special, consequential, or punitive damages arising from website use or service communications. We may update these terms as our services, website, and operations evolve.
